Terms of Service.
The following terms and conditions (“Terms of Service” “Terms”) are made for the purpose of providing standards for which the psychotherapy, including art therapy, and mental wellness services (“Service”) of Two Pines Art Therapy (“Service Provider”) operate.
Two Pines Art Therapy encourages individuals (the “Client” “Participant”) to exercise their choice in the pursuit of their goals and the planning and delivery of their supports.
Please read these Terms of Service before using the service. Your access to and use of the service is based on your acceptance and compliance with these Terms. By accessing or using the service you agree to be bound by these Terms.
1. Service
Two Pines Art Therapy provides mental health services for individuals and groups.
2. Payment of Service
The method for payment for service is email transfer to janet@twopinesarttherapy.com.
The Service Provider can make a request for payment of the Fees either before or once the relevant Services have been delivered or provided to the Participant.

3. Cancellation Policy
Individual appointments can be cancelled without incurring a fee if the Client notifies the Service Provider at least 24 hours before the scheduled session. Missed or cancelled appointments with less than 24 hours notice will be charged 75% of the full fee, except in the case of medical emergencies.
There are no refunds on any group programs, which include art therapy groups, general groups, and art hives. Clients may request to defer to the same type of group at a future date no later than 24 hours after the first session of the group has been completed. Clients can choose to cancel the group at any time without refund.
4. Rights and Responsibilities of the Client
The Client agrees to:
talk to the Service Provider if they have any concerns about the Services being provided;
inform the Service Provider about how they wish the Services to be delivered to meet their needs;
give the Service Provider the required amount of notice (24 hours) if they cannot make a scheduled appointment; and if the notice is not provided by then, the client will be charged 75% of the full fee.
treat the Service Provider and other clients of the Service Provider with courtesy and respect and ensure that their representatives, family members and support persons do the same.
5. Confidentiality
The Service Provider will protect and maintain confidentiality at all times. Case notes will be stored in protected files that can only be accessed by the Service Provider. Any art works or materials created in the session may photographed with the Client’s permission or stored in protected files as requested by the Client and treated as case notes.
If information needs to be shared (e.g. another health professional), the Service provider will request consent from the Participant before it may occur.
There are some limits to confidentiality. The Service provider have the obligation to share information without your permission only if:
– there are concerns about the Client being at risk to harm or kill themselves or others;
- the Client discloses previously undisclosed sexual offenses, or other serious, violent crimes against identifiable individuals;
- the Client discloses information that would indicate a particular child (or children) under the age of 18 years has been harmed (physically, sexually, emotionally or neglected) or at risk of being harmed or neglected;
- the Client discloses that a particular individual is in possession of, distributing, or producing sexual images or stories of children under 18;
- the Client discloses sexual abuse by a regulated health professional, such as a doctor, psychologist, dentist or nurse. The professional in question will be reported, understanding that it is not necessary to provide the Client’s name;
– a court orders the Client’s records, they may have to be provided.
If any of these situations arise the Service Provider will discuss it with the Client and advise of the due process.
6. Changes to this Service
If changes to the services or their delivery (including the Service Fees) or the Terms of Service are required, the Parties agree to discuss and review.
7. Termination of Service
The Client may end this service at any time. Should the Service Provider wish to end this service, the Service Provider will provide notice and discuss alternative support options that the Client may choose to exercise in the pursuit of their goals.
If the Client seriously breaches the terms, the requirement of notice will be waived.
8. Limitations of Liability
Two Pines Art Therapy, its business and people, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of the Service; (ii) your inability to access or use the Service; (iii) any conduct or content of any third-party on or related to the Service; (iiv) any content obtained from or through the Service; and (v) the unauthorized access to, use of or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other claim in law, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Governing Law
Any claim relating to Two Pines Art Therapy shall be governed by the laws of the Province of Ontario without regard to its conflict of law provisions.
10. Indemnity
As a condition of your use of this Site, you indemnify Two Pines Art Therapy and its owners and affiliates from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting or arising from your use of this Site.
11. Agreement to Terms of Service
By engaging in the service, the Client agrees that the Terms of Service have been read, understood, and will abide by the Terms.
